Extracto del Memo de la Calle Downing (sobre la reunión del Gabinete el 23 de Julio de 2002):

“(…)C reportó en sus charlas recientes en Washington. Se podía sentir un cambio en la actitud. Una acción militar se veía ahora como inevitable. Bush quería remover a Saddam, por medio de la acción militar, justificadas con la conjunción del terrorismo y las armas de destrucción masiva. Pero la inteligencia y los hechos estaban siendo arreglados para satisfacer esta política. El NSC [Consejo de Seguridad Nacional] no le tuvo paciencia a la ruta de la ONU, ni tuvo entusiasmo en publicar material de los registros del régimen Irakí. Es por esto que apenas hubo discusión en Washington sobre el resultado de una acción militar.(…)

Resultaba claro que Bush había resuelto tomar acciones militares, aún cuando el momento no estuviese decidido. Pero el caso era débil: Saddam no amenazaba a sus vecinos, y su capacidad de armas de destrucción masiva era mucho menor a la de Libia, Corea del Norte o Irán. Deberíamos planificar un ultimatum a Saddam para que permita volver a los inspectores de armas de la ONU. Esto ayudaría también la justificación legal para el uso de fuerza.

El Abogado-General dijo que el deseo del cambio de régimen no era una base legal para la acción militar. Habían tres posibles bases legales: defensa propia, intervención humanitaria, o la autorización del Consejo de Seguridad de Naciones Unidas. La primera y segunda no podían servir de base en este caso. Depender de la Resolución del CSNU 1205 de hace tres años habría sido difícil. Por supuesto, la situación podía cambiar.”

Excerpt from the Downing Street Memo (about the Cabinet meeting on 23rd July 2002):

“(…)C reported on his recent talks in Washington. There was a perceptible shift in attitude. Military action was now seen as inevitable. Bush wanted to remove Saddam, through military action, justified by the conjunction of terrorism and WMD. But the intelligence and facts were being fixed around the policy. The NSC had no patience with the UN route, and no enthusiasm for publishing material on the Iraqi regime’s record. There was little discussion in Washington of the aftermath after military action.(…)

It seemed clear that Bush had made up his mind to take military action, even if the timing was not yet decided. But the case was thin. Saddam was not threatening his neighbours, and his WMD capability was less than that of Libya, North Korea or Iran. We should work up a plan for an ultimatum to Saddam to allow back in the UN weapons inspectors. This would also help with the legal justification for the use of force.

The Attorney-General said that the desire for regime change was not a legal base for military action. There were three possible legal bases: self-defence, humanitarian intervention, or UNSC authorisation. The first and second could not be the base in this case. Relying on UNSCR 1205 of three years ago would be difficult. The situation might of course change.”
